Man sobs as he gets jail for pepper spray attack on MPSJ officer

pepper-spray-man-jailPETALING JAYA: The Magistrate’s Court today sentenced a 50-year-old man to five months’ jail after he attacked a Subang Jaya Municipal Council (MPSJ) enforcement officer with pepper spray last week.

Leng Wan Kwan, who is unemployed, was also fined RM3,000 in default of three months’ jail, the New Straits Times reported.

Leng was sobbing as Magistrate Nurulhuda Zakariya meted out the sentence after he had pleaded guilty to using criminal force to obstruct a public servant from carrying out his duty.

The father of three was charged with obstructing Norsafuan Nordin, 31, from carrying out his duty as an MPSJ officer in front of a restaurant at Jalan Puteri 1/4, Ban dar Puteri, Puchong about 12.40pm on Nov 7.

The defendant, who was unrepresented, pleaded for a lenient sentence as he had been jobless for the past four months.

“I underwent an eye operation several months ago and have not been able to work since,” he said.

However, deputy public prosecutor Natasya Chin Le Jy pressed for a deterrent sentence, saying the public should respect civil servants who were carrying out their duties.

The court ordered Leng’s jail term to run from the date of his sentencing.

Leng’s wife, who was present in court, was seen holding back tears as he was taken to the lock-up after proceedings.

According to the facts of the case, Leng and his wife acted aggressively towards Norsafuan after he clamped Leng’s white Honda City which was illegally parked.

In the midst of the argument, the accused used the pepper spray on Norsafuan, which left him with breathing difficulties.

Norsafuan later lodge d a police report on the incident.
